Coal Rights and Severed Mineral Estates in Appalachia

Across much of Appalachia, coal was conveyed away from the surface generations ago, sometimes together with other minerals and sometimes alone. Understanding which estate you hold is essential.

Severance and what it creates

A severance separates one or more mineral estates from the surface. After severance, the mineral owner and the surface owner are different parties with different rights, and each estate can be sold, leased and inherited independently.

Coal severances, oil and gas severances and surface conveyances often happened at different times and to different parties under the same ground.

Coalbed methane

Whether coalbed methane belongs to the coal estate or the gas estate has been litigated and legislated differently across Appalachian states, and southwest Virginia in particular has a distinct history including regulatory escrow procedures.

This is a legal question that turns on the specific deeds and the law of the specific state. It should never be assumed from what happened in a neighboring state.

Reading reservations and exceptions

Older instruments may reserve all minerals, only coal, only oil and gas, or specific strata. Mining and surface support rights may be attached.

Because a few words can change the outcome, an attorney or title professional in the mineral state should interpret them.
