Appalachian Oil and Gas Royalty Interests

A royalty interest is the right to a share of production revenue without bearing the cost of drilling and operating. It is related to, but not the same as, owning the minerals.

Mineral interest versus royalty interest

A mineral interest generally includes the right to explore, to lease, to receive bonus and rentals, and to receive royalty. A royalty interest is usually just the revenue share, without the right to lease.

An owner can hold one without the other. Selling a royalty interest and selling the underlying minerals are different transactions with different consequences.

Overriding royalty and working interests

An overriding royalty is carved out of the working interest rather than the mineral estate, and it typically ends when the lease ends. A working interest carries a share of operating costs and potential liability, which makes it fundamentally different from a royalty.
